Terms of Service – Fashio AI

1. The Service

Fashio AI is an artificial intelligence-based photo generation platform that allows users to create fashion product visuals using synthetic models. The Platform is provided on a subscription or credit-based model.

2. Eligibility and Access

• Age Requirement: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use this Platform and enter into a binding contract.
• Account: To access certain features, you must create an account. You are responsible for maintaining the security of your account and for all activities that occur under it.
• No Free Trial: Fashio AI does not offer a free trial period. Access to premium features and AI generation requires the purchase of credits or a subscription as specified on the Platform.

3. User Content and Data

• Ownership: You retain all rights to the photos you upload to the Platform ("User Content").
• License to Us: By uploading content, you grant Fashio AI a worldwide, royalty-free license to process, host, and use your images solely to provide and improve our AI services.
• Prohibited Content: You may not upload content that is illegal, offensive, pornographic, or infringes on the intellectual property rights of others.

4. Fashio AI Intellectual Property

• Platform Ownership: All rights, titles, and interests in the AI models, software, "look and feel," and the technology behind Fashio AI belong to us.
• Licensed Photos: We grant you a non-exclusive, limited license to use the photos generated by our AI for your own fashion business needs.

5. Subscriptions and Credits

• Payment Models: We offer both recurring subscriptions and one-time credit purchases. "Credits" are used for AI generation features. Subscriptions may include an allotment of Credits or access to premium tools. Both can be purchased via our secure global payment processors that are industry-approved.
• Refund & Cancellation Policy: If you are not satisfied with your purchase, you may request a refund for unused credits within 3 days of your transaction by emailing us at hi@fashiolabs.com. Subscriptions can be canceled at any time, and the cancellation will take effect at the end of the current billing cycle.
• Price Changes: We reserve the right to change our fees or credit pricing at any time with notice to you.

6. Acceptable Use

You agree not to:

• Reverse engineer or attempt to extract the source code of the AI models.
• Use the Platform to create harmful, deceptive, or malicious content.
• Use automated systems (crawlers, scrapers) to access the Platform.

7. Termination

• By You: You may stop using the Service at any time.
• By Us: We may suspend or terminate your access immediately if you violate these Terms or if your use poses a security risk.
• Effect of Termination: Upon termination, your right to use the Platform ceases, and we may delete your stored data.

8. Disclaimers and Limitation of Liability

• "As-Is" Basis: The Platform and generated photos are provided "as-is." AI generation can occasionally produce inaccurate or unexpected results.
• Liability Cap: To the maximum extent permitted by law, Fashio AI’s total liability for any claim shall not exceed the amount you paid us in the six months prior to the claim.

9. Changes to Terms

We may update these Terms from time to time by posting the new version on fashiolabs.com. If the changes are material, we will notify you through the Platform or via email.

10. Governing Law

These Terms are governed by the laws of the jurisdiction where our company is incorporated, without regard to conflict of law principles.
