Fashio AI ("we", "our", or "us") is committed to protecting your privacy. This Privacy Policy outlines how we collect, use, store, share, and safeguard your information when you use our website (fashiolabs.com), mobile applications, and all related software-as-a-service (SaaS) offerings (collectively, the "Services"). Our Services are designed for users aged 18 and older. By accessing or using our Services, you agree to the practices described in this Privacy Policy.

1.1 Information You Provide

  • Account Information: When you create an account, we may collect your name, email address, and authentication credentials (including via third-party sign-in providers such as Apple Sign-In, Google Sign-In, or email/password).
  • User-Uploaded Images: To provide our core AI fashion visualization features, you may upload photos of clothing or yourself. These images are processed on secure servers solely to generate AI-based previews.
  • Payment Information: When you make a purchase, payment details are processed by our third-party payment processors (e.g., Stripe, Apple In-App Purchase). We do not store your full credit card number on our servers.
  • Communications: If you contact us via email or support channels, we collect the content of your messages and any information you choose to provide.

1.2 Information Collected Automatically

  • Device Information: We may collect device type, operating system, unique device identifiers, browser type, and language preferences.
  • Usage Data: We collect information about how you interact with our Services, including pages visited, features used, timestamps, and referring URLs.
  • IP Address: Your IP address is collected for security, analytics, and to determine your approximate geographic location.
  • Anonymous User ID: We assign a unique, non-personally identifiable ID to each user to link uploaded content to your session without requiring sensitive personal data.

  • Social Login Providers: If you sign in using Apple, Google, or other third-party providers, we receive your name, email address, and profile picture as permitted by your privacy settings on those platforms.
  • Analytics Providers: We may receive aggregated or anonymized data from analytics partners to understand usage trends.

  • Provide, maintain, and improve our Services, including AI-powered fashion transformations, virtual try-ons, and mannequin visualizations.
  • Process transactions and send related information.

  • Monitor and analyze trends, usage, and activities to improve user experience.
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities.

5. Data Storage, Security, and Retention

  • Industry-Standard Security: Your data is protected using encrypted storage (AES-256), TLS/SSL encryption in transit, and industry-standard security protocols to prevent unauthorized access.
  • Short-Term Image Retention: Images uploaded for AI processing are stored temporarily. Once the AI model has completed the generation (typically within 1 hour), the original source images are permanently deleted from our processing servers.
  • Account Data Retention: We retain your account information for as long as your account is active or as needed to provide you with our Services. You may request deletion at any time.
  • Access Control: Access to processing servers is strictly restricted to authorized technical personnel and is subject to regular security audits.

6. Facial Data Collection and Usage

In compliance with global privacy standards (including GDPR, CCPA, and BIPA where applicable):

  • No Biometrics: We do not extract biometric templates or facial recognition points intended for identity verification.
  • Usage: Facial data is used strictly as a visual reference for AI "try-on" features and is not used for any other purpose.
  • Deletion: Facial data is automatically deleted within 1 hour after processing is complete.
  • Third-Party Disclosure: We never sell, rent, or share facial data with third-party advertisers or data brokers. Processing is handled internally or via highly secure, vetted infrastructure partners under strict confidentiality agreements.

7. International Data Transfers

Your information may be transferred to and processed in countries other than your own. We ensure that appropriate safeguards are in place for international data transfers, including Standard Contractual Clauses (SCCs) approved by the European Commission, or other legally recognized transfer mechanisms. By using our Services, you consent to the transfer of your information to countries that may have different data protection laws than your country of residence.

8. Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Right to Access: Request a copy of the personal data we hold about you.
  • Right to Rectification: Request correction of inaccurate or incomplete personal data.
  • Right to Erasure (Right to be Forgotten): Request deletion of your personal data, subject to legal obligations.
  • Right to Restrict Processing: Request that we limit the processing of your personal data under certain circumstances.

  • Right to Non-Discrimination: You will not receive discriminatory treatment for exercising your privacy rights (CCPA).

9. Account and Data Deletion

You may request the deletion of your account and all associated data at any time by contacting us at hi@fashiolabs.com. Upon receiving a verified deletion request, we will delete your personal data from our active systems within 30 days. Some data may be retained in backup systems for a limited period as required by law or for legitimate business purposes, after which it will be permanently deleted.

10. Subscriptions and In-App Purchases

  • Fashio AI Plans & Credits: Our services operate on both a subscription plan model and a credit-based system to access premium AI features.
  • Secure Transactions: All purchases are handled through secure, encrypted payment gateways. We do not store your complete payment card details.

11. Children's Privacy

Our Services are not directed to individuals under 18 years of age. We do not knowingly collect personal data from children under 18. If we become aware that a child under 18 has provided us with personal data, we will take immediate steps to delete such information. 12. "Do Not Track" Signals

Some browsers offer a "Do Not Track" (DNT) setting. We currently do not respond to DNT signals, as there is no industry-wide standard for handling them. However, you can manage your cookie preferences and opt out of tracking as described in Section 3.

13. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will notify you via email, in-app notification, or by posting a prominent notice on our website. The "Last Updated" date at the top of this policy indicates when the latest revision was made.
